Bulgaria: Council of Europe, SJC should be reformed

Venice Commission, some critical points remain

(ANSA) - STRASBOURG - Bulgaria has made progress but needs to carry out some more reforms to strengthen and fill the gaps of its Supreme Judicial Council, according to Venice Commission, which calls on the Bulgarian authorities to introduce a number of key measures. Above all, they should ensure that at least half of the judges who make up the SJC are elected by their peers. The Commission also urges the government to reduce the ''relevant role played by the Public Prosecutor in presiding over judges''. The Commission also calls on the SJC to opt for a procedure which will enable it to independently and effectively investigate into complaints of prosecutor's misconduct and to ''substantially reduce'' the role and power of the public prosecutor beyond the criminal law.
