(ANSA) - STRASBOURG, 07 FEB - The European Court of Human
Rights (ECHR) has condemned Serbia because a judge failed to
allow a lawyer to express himself in one of two national
language variants during a criminal trial. The country
officially recognizes the possibility of using the two variants
of the Serbian language, Ekavian and Ijekavian, in court.
Still, a lawyer was denied the opportunity to use the second
one, whereas the opposing party's lawyer was allowed to speak in
Ekavian without obstacles. Serbia was convicted of
discrimination because the Constitutional Court violated the
right to a fair trial by failing to provide adequate reasoning
for refusing to adjudicate the lawyer's appeal against his
treatment. Belgrade will have to compensate the man 2,000 euros
in moral damages for violating his rights. (ANSA).
