Court OKs two-mother child registration

One woman donated eggs, other carried and gave birth to baby

(ANSA) - Rome, September 30 - The supreme Court of Cassation on Friday okayed the registration of the birth certificate of a child born with two mothers. The mothers were a married lesbian couple who subsequently divorced. One, an Italian woman, donated the eggs and the other, a Spaniard, carried the baby and gave birth to him in Spain in 2011. The supreme court ruled that there was no "Constitutional ban" on same-sex couples "welcoming and generating children" even though there is no Italian legislation for such cases. It upheld a ruling at the Turin court of appeal, which had ordered the northern city's registry to put the birth certificate on record. A lower court had denied permission to register the child in this way on the grounds that it conflicts with the principle that the mother is the person who gives birth to a child.
