Prosecution opposes recognition of US adoption by gay mum

Juvenile court in Bologna due to examine case soon

(ANSA) - Bologna, October 16 - Bologna prosecutors on Thursday stated their opposition to an application by an Italian university lecturer to the local juvenile court to have her United States-sanctioned adoption of her female partners' daughter recognised in Italy.
    The application was brought after the woman returned from the United States to live in Italy with her American partner, whom she married in 2013, and their two children, a boy and a girl, both conceived by donor fertility treatment.
    The boy was born to the Italian national and the girl to her partner.
    Following their birth the two women both obtained the adoption of the other's child under US law in such a way as to each have full parental responsibility for both children.
    However, Italian prosecutors claim that to recognise the adoption of the girl in Italy would be contrary to Italian law.
    Instead lawyer Claudio Pezzi argues that failure to do so would be tantamount to denying the "filiation" that has linked the girl to her adopted mother and also to her brother "since birth". "Further, she would be deprived of the right to Italian and European citizenship as the daughter of an Italian citizen, with all the cultural, social and legal consequences that this would entail," he continued.
    The Bologna juvenile court is due to rule on the case shortly.
