Spouses leaving sexless marriages not liable says court (ANSA) - Rome, February 5 - Spouses who leave a marriage grown sexless are not liable for fault divorce, Italy's supreme court ruled Wednesday.

The ruling came in the case of an Italian woman who wanted her ex husband to be held liable for their divorce after he left her for another woman. She also sought damages, which a lower court had denied.

The man left because the couple had stopped having sex after the birth of their son nine years ago.

"Abandoning the conjugal home does not constitute a fault when the spouse who left can prove that living together had become intolerable," the court wrote in its opinion. Lack of sex falls under that definition of intolerable circumstances, the court said.
