(ANSA) - Rome, January 29 - Italy's supreme Court of
Cassation on Tuesday ruled that building managers who attempt to
publicly shame tenants into paying their condominium dues can be
sued for defamation.Italy's highest appeals court issued its ruling following the case of a condominium manager who put a notice on his building's elevator listing the names of those who were overdue with their fees and warning them that if they did not pay within two days their water would be shut off. One of the building's tenants pressed charges, claiming that part of the missed payment regarded a previous tenant, and the notice harmed his reputation.
Two previous courts ruled in favor of the plaintiff. The Cassation Court said the landlord should have "been more careful about the content of the information" in his warning.
