Italy's supreme Court of Cassation
on Monday ruled that migrants who need specific post-operative
healthcare treatments can stay in Italy without risking
expulsion and without a specific stay permit for health reasons.
The Court ruled on an appeal brought by a Peruvian woman
who was served with an expulsion order validated by a justice of
the peace in Rome last year for not requesting a specific stay
permit for health reasons, despite her need for post-operative
care following a complicated operation.
In its ruling the Court said guaranteeing a foreign
citizen's fundamental right to health while in Italy prevents
expulsion.
