The European Court of Justice
(ECJ) ruled Thursday that repatriated non-EU citizens can be
jailed if they violate a ban on re-entry.
The ECJ ruled on a petition filed by a Florence court in
the case of an Albanian man who re-entered Italy in spite of
being expelled with a three-year ban.
Prosecutors sought an eight-month sentence under an Italian
law which says foreign citizens who violate a ban and enter the
country illegally can be punished with one to four years in
prison.
The Florence court then asked the ECJ whether that law is
in line with EU directives on repatriations.
The EU court replied that there is no conflict between the
two laws.
